These Terms and Conditions governs the state of all goods by us and will form the basis of the contract between you and us. If you wish to place an order with us, our Website or Application will guide you through the ordering process. Before submitting your order to us, you will be given the opportunity to review and amend it. Kindly ensure that you have checked your order and that you have read these Terms and Conditions carefully before submitting it. 1. SERVICES OFFERED

1.1. This TERMS applies to regulate the use of the service offered by samdadfood.com to USERS, that is, to allow the choice, by USERS, of registered RESTAURANTS and, via online, make requests for acquisition (and home delivery) and on-site pickup) of food supplied by RESTAURANTS, according to the menus provided, and it is also possible for USERS to pay the price of the products via online.

1.2. The samdadfood.com service, therefore, consists of bringing the registered USERS and RESTAURANTS closer to our website, enabling USERS to forward food delivery orders to RESTAURANTS, as well as, this being the option of the USERS, to receive online payment of the price of the products delivered to the USERS by the RESTAURANTS.

1.3. It is immediately clear to the USER – who declares himself aware-that the service offered by samdadfood.com relates only to inter-mediation(with an online payment option) for the sale of food products, not including preparation, packaging, availability and physical delivery of the products, these four items being the RESTAURANTS's full responsibility, to who many complaints regarding problems arising from addiction, defect or failure to make, prepare and deliver food products should be directed.

2. REGISTRATION

2.1. The USERS, in order to use the services described above, must have legal capacity for civil acts and must necessarily provide the information required, assuming full responsibility (including civil and criminal) for the accuracy and veracity of the information provided, which can be verified at anytime by samdadfood.com

2.1.1. In case of incorrect, untrue or unconfirmed information, as well as in the event of refusal to correct them or send documentation proving the correction, SamDad Food reserves the right not to complete the registration in progress or, still, to block the existing registration, preventing the USERS from using the online services until, at the discretion of samdadfood.com, the anomaly situation is reserved. SamDad Food reserves the right to prevent, at its discretion, new entries, or cancel already made, in case of being detected anomaly that, in its analysis, be coated with gravity or show deliberate attempt to circumvent the rules described here, mandatory forall USERS.samdadfood.com will also act in such a way if the USERS fail to comply with any obligation provided for in this TERM.

2.2. Once the REGISTRATION has been successfully completed, the USERS will have access to the services through login and password, data that he undertakes not to disclose to third parties, being under his exclusive responsibility any service request that is made with the use of login and your ownership password.

3. USER’S OBLIGATIONS

3.1. Once the USER'SREGISTRATION has been successfully completed, the user is obliged not to disclose login and password details to third parties, nor to allow the use of such information by third parties, being responsible for the consequences of the use of his/her login and password.

3.2. It is the obligation of the USER to provide registration information that is completely true and accurate, being exclusively and fully responsible (in all legal fields) for all the content informed by him in this TERM, keeping updated and confirmed the address for delivery of the ordered food products.

3.3. The USER is also obliged to pay in full the price of the products ordered or ordered from the RESTAURANT and effectively delivered to him, either by online modality or by any other means, directly to the bearer of the products ordered through this website (cash, mobile money,etc.).

3.4. The USER who is under 16 years of age is aware that he will not be able to order and purchase, under any circumstances, alcoholic products, being responsible for the correct information of his age in the REGISTRATION item.

3.5. The USER agrees with the use of the information of evaluations and feed backs of the services of the RESTAURANTS and of SamDadFood, as described in the PRIVACY TERMS of SamDad Food.

4. SAMDAD FOOD’S OBLIGATIONS

4.1. Make available on the samdadfood.com website a virtual platform that allows the USER duly registered to place orders for the purchase of foodstuffs advertised and marketed by RESTAURANTS and also provide the USER with means of payment for the price of foods online.

4.2. Protect, by means of storage on servers or any other highly secure magnetic means, the confidentiality of all information and records related to USERS, as well as values related to financial operations arising from the operationalisation of the services provided for in this TERM. However, it will not be responsible for repairing losses that may be derived from the seizure of data by third parties that, breaking the security systems, are able to access this information.

5. MODIFICATIONS TO THIS TERM

5.1. This TERMS ANDCONDITIONS may, at any time, have its content, or part of it, modified for adjustments and insertions, all with a view to improving the services provided.

5.2. The new conditions will come into force as soon as they are posted on the website, and it is possible for the USER to express opposition to any of the modified terms, provided that he does so in writing, through thesamdadfood.com website, which will cause the cancellation of his REGISTRATION.
